All orders are subject to our full terms and conditions (below). Nothing in these conditions affects your statutory rights as a consumer.


Standard conditions of sale

I. Definitions

  • "Buyer" means the person who buys or agrees to buy the Products from the Seller

  • "Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller

  • "Delivery date" means the date specified by the Seller when the Products are to be delivered

  • "Products" means those goods specified

  • "Price" means the price for the Products including packing, but excluding delivery charges

  • ''Seller" means the Incredibledeco company based at unit 9 Industrial Commercial Business, Botany Avenue, NG18 5NE, Mansfield

    II. Conditions applicable

  • Nothing in these conditions shall affect the buyer’s statutory rights as a consumer

  • The Seller shall sell and the Buyer shall purchase the products in accordance with any written quotation of the Seller which is accepted by the Buyer, or any written or verbal order of the Buyer which is accepted by the Seller including but not limited to orders placed using the Seller’s electronic online ordering service, subject in any case to these conditions, which shall govern the contract to the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted, or any such order is made or is purported to be made, by the Buyer.

  • Any typographical or clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.

  • If any provision of these conditions is adjudged invalid or unenforceable in whole or in part the validity of the other provisions of these conditions and the remainder of those provisions in question shall not be affected.

  • If the Seller does not have sufficient stock to be able to deliver the goods ordered by the Buyer then any sum paid by the Buyer will be refunded or re-credited to your account and the Seller will notify you at the address given by you in your order form. The refund will be made as soon as possible and, in any event, within 30 days of your order and the Seller will not be obliged to offer any compensation for disappointment suffered.

  • The Seller reserves the right to refuse orders that contain dubious or incomplete data. Purchaser will be immediately informed of the existence of such a situation.

  • The Seller reserves the right to cancel the contract in the event of unforeseen changes in the parameters of the ordered models of furniture, or in case of changes specified by the manufacturer.

III. The price and payment

  • Price shall be always same as stipulated in the Seller’s published price list current at the date of order of the Products. Any event of any increase in the cost to the Seller of raw materials, labour, overheads, or any increase in taxes or duties, or any variation in exchange rate the Seller may increase the Price payable under the contract upon written notice. If notice of price increase is given by the seller, the buyer shall have the right to cancel the order and receive back any sums they have paid. Notice of cancellation must be received in writing by the seller within seven days of delivery of the notice of price increase to the buyer.

  • Payment of the Price shall be due at the date of the delivery. Time for payment shall be of the essence. If the Buyer does not pay the Price on notification of shipment the Seller may bring an action for the Price even though property in the Products has not been passed to the Buyer. If the Buyer fails to make payment as required the Seller may suspend delivery of the Products or any further Products ordered until payment is made in full.

IV. The products

  • The quantity and description of the Products shall be set out in the Seller’s quotation.

  • The Seller may make any changes in the specification of the Products which do not materially affect their quality or performance required to confirm with any applicable statutory requirements where the Products are supplied to the Seller’s specification.

  • Photographs are for illustrative purpose only, and may not exactly match the product itself, especially colours of materials.

  • Before the order please make sure the our furniture especially sofa will fit inside your home. This is especially important for large and corner sofas. There is a margin of error. Actual dimensions of upholstered furniture may differ from those provided in the item description by +/- 2 cm.

V. Warranties and liability

    • All goods supplied by the Seller come with a manufacturer’s warranty of 12 months unless sold as damaged or ex display.

    • The Seller shall provide the Buyer with such information as is required to claim under the manufacturer’s warranties. In the event of a claim, the Buyer shall in the first instance contact the Seller’s customer service department.

    • The Seller does not provide any warranty cover against defects in his own right.

    • Except where the Buyer acts as a Consumer all other warranties, conditions and terms relating to fitness for purpose, satisfactory quality or conditions of the products whether implied by statute or common law or otherwise are excluded to the fullest extent of the law.

    • Our only liability to you under these terms and conditions will be, at our sole discretion, to make good any shortage or non-delivery, to replace or repair any goods which are received by you in a damaged or defective state or to refund to you any sums actually paid by you for the goods in question. We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us and will have no liability to you for any failure or delay in delivering goods or any damage or defect in goods delivered which is caused by any event or circumstance which is beyond our reasonable control. Nothing in this subsection affects your statutory rights as a consumer.

VI. Delivery, Returns and Cancellations

    • Delivery cost depends on distance between the destination and our office/showroom.

    • You can check it easily yourself by using Google Map. Please check the distance between your post code and our NG18 5NE postcode, then simply select the appropriate position from the price list.

    • Price of delivery may be different than stated below for orders of furniture with large dimensions difference (in case of very large dimensions price may increase, in case of small furniture in packages price may be lower), but you'll be informed about it after you place your order and you'll have right to cancel your order if, you won't be happy with delivery charge.

  • The seller should inform the buyer about the date when he is willing to deliver the goods minimum 2 working days before

  • If the Buyer is dissatisfied with his purchase for any reason he may, within 10 days of delivery, contact the Seller’s customer service department to notify them that he wishes to return some or all items from his order. The Buyer should arrange to return the goods himself to the Supplier at his own cost. Goods must be returned to the Seller in the same condition they were in at the time of delivery to the Buyer and in their original packaging or similar. Items which are not adequately packaged at time of collection may not be collected. Refunds will be issued within 30 days of receipt of goods and after we have inspected them for damage. We reserve the right to withhold all or part of your refund if items are returned damaged.

  • Most of the products seller needs to order from the manufacture. To make sure that buyer is willing to purchase the goods seller may ask buyer to put a non refundable deposit on it. It is in customer interest to make sure that he is sure what he wants to buy. Once buyers place the order and pays deposit the seller is placing the order with the manufacture understanding that buyer did his measurements and calculations.

  • Delivery drivers as standard will not carry items upstairs and all transportation of your goods to a location upstairs is entirely carried out at the buyer risk and discretion.
    Our drivers are unaccompanied; they will not move or take away any existing goods.

  • There are additional charges for carrying furniture to house £20, upholstered furniture  assembly charge £30 and hard furniture charge £70.

 

  • Returns and Cancellations

    Cancellations pre-delivery The buyer may cancel their order before delivery with no cost by informing the Seller in writing, by sending an e-mail to the address incredibledeco.mansfield@gmail.com or by calling our Customer Service. Once ordered Goods have arrived the Buyer is subject to accepting Goods.

  • Returns after delivery

    The Buyer can, within 14 days of receiving the order, change their mind and inform the Seller of his intention to return the order. In such case the Buyer should arrange to return the goods himself to the Supplier at his own cost.

    In case of return The Buyer has to ensure that any item is available for collection within 14 days.

    The Buyer has to ensure any item they wish to return is in the condition they have received it in. The Seller will not be able to refund the Buyer in full if there are any signs of damage or misuse. Should the Buyer wish to return the goods it is their responsibility to take good care of the furniture. The Buyer is the owner of the furniture once it has been delivered and is liable for any loss or damage. Failure to take reasonable care may result in a claim against the Buyer. To minimise the risk of any such claim The Seller asks that the Buyer returns the goods in appropriate packaging such as to prevent damage in transit. The Buyer has a statutory duty to take care of the goods. In cases of cancelled orders, where the goods are returned damaged or distressed, worn, scratched, modified or missing any of the supplied parts or equipment the Seller reserves the right to make appropriate reductions to the amount of money returned to the Buyer, up to the full cost of the product, depending on the state the product is returned in.

    Once The Buyer has confirmation that the Seller received their cancellation and the item is back in the Seller’s warehouse and has been inspected for any damages and missing pieces, the Buyer will receive their refund via the original payment method used, less the cost of the collection of the item.

    In case where applicable, the Buyer authorises the Seller to recover the Collection Service Charge by: ◦ debiting any credit or debit card of the Seller, immediately following any refund made pursuant to the appropriate refund terms. ◦ setting-off the Service Charge against any refund made

    The Buyer acknowledges that the Seller may apply a Charge for any damages, that will compensate the Seller for any loss suffered as a result of the Customers failure to take reasonable care of the Products.

    Refunds made to a credit or debit card or via PayPal may not show in the Buyer’s account straight away due to the clearing time required by banks to process the refund. This can take up to several working days, but varies depending on the bank. Please contact the card issuer or bank directly with any queries.

  • Exceptions from the right to withdrawal 1. With compliance to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Part3, Regulation 28, Schedule 1, subsection B) the exceptions to the buyers right to withdraw from a contract (if they change their mind) include:

  • Due to hygienic reasons: Mattresses, sofa beds or unfolding chairs unless they are unopened, unused and packed or have been used without a mattress protector.

  • Any mattresses or sofa beds that have been unsealed will be deemed as having been used, therefore they cannot be returned for any reason other than being not of satisfactory quality or not as described.

  • Bespoke items, which are those that are custom made or personalised in any way. This means they are bespoke to the individual and therefore cannot be resold as the Goods are specified or personalised by the buyer in his order, to fit for the buyer's clearly specified needs. Sofas, beds, table and chair sets made to specific order, where the buyer will choose a colour combination, fabric, side of the corner sofa or size that are not the standard variant of the product. Bespoke, made to order items are excluded from standard returns policy. Personalised or bespoke products cannot be returned for any reason other than being not of satisfactory quality or not as described. ◦ The Seller does not accept returns of items sold in flat-packs, as selfassembly, which have been assembled or partially assembled for any reason other than being not of satisfactory quality or not as described. If the Buyer notices that the product is damaged before or during assembly, they should not attempt further assembly, stop and contact the Seller so that replacement parts can be provided. Do not try to assemble an item if it is damaged. If the Buyer is responsible for any further physical damage to the item they will be charged.

  • Consumers returning self-assembly goods bought at a distance or offpremises will be liable for any diminished value of returned goods that results from the consumer handling the goods beyond what is necessary to check them. The above condition is due to the fact the Seller will be unable to specify if the item was damaged by the Buyer or, if it was delivered in such condition, if the Buyer assembles it before informing the Seller of the problem.

  • VII. Exceptions from the right to withdrawal

With compliance to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Part3, Regulation 28, Schedule 1, subsection B) the exceptions to the buyers right to withdraw from a contract include:

  • A contract to supply a service, if the seller has completed the service in full, with the buyers knowledge and agreement, when the buyer was informed in advance that upon the completion of the service he will not be able to withdraw from the contract.

  • Contracts for non- prefabricated goods, made to order to the buyers specification (e.g. bespoke furniture or sofas specified or personalized by the buyer in his order) or fit for the buyer's clearly specified needs.

  1. Acceptance of the products

    • Other than where the Buyer acts as a Consumer the Buyer shall be deemed to have accepted the Products 14 days after delivering to the Buyer.

    • After acceptance the Buyer shall not be entitled to reject Products which are not in accordance with the contract.

  1. Title and risk

  • Risk of damage to or loss of the Products shall pass to the Buyer upon collection.

  • Any Products shall not be pass to the Buyer until the Seller has received clear funds payment in full.

  • The Buyer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the Products which remain the property of the Seller, but if the Buyer does so all moneys owing to the Seller shall (without prejudice to any other right or remedy on the Seller) immediately become due and payable.

  1. General

    • Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to strikes, lock outs, accidents, war, fire, reduction in or unavailability of power at the Seller’s premises or its manufacturing plant, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

    • Any notice required or permitted to be given by either party to the other under the conditions shall be in writing and in the case of notices to the Seller, addressed to the Seller at its registered office or in the case of notices to the Buyer, at the Buyer’s address as provided to the Seller.

  1. Headings

    • The headings of the clauses in these conditions are intended for reference only and will not affect the construction of these conditions.

    • Representations:
      No statement, description, warranty condition or recommendation contained in any catalogue, price list or advertisement or communication or made verbally by any of the Agents or Employees of the Seller shall be construed to enlarge, vary or override in any way thereof any of these conditions.

    • Additional costs:
      The Buyer agrees to pay for any loss or extra cost incurred by the Seller through the Buyers instructions or lack of instructions or through failure or delay in taking delivery or through any acts or default on the part of the Buyer, its servants, agents or employees.

VIII Klarna

English:

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment methods. Payment is to be made to Klarna.

  • Pay in [14] days: The payment period is 14 days from shipment of the goods or tickets/ availability date of the service.   • Slice it: With the financing service from Klarna you can pay your purchase in flexible or fixed monthly instalments according to the conditions stated in the checkout. The instalment payment is due at the end of each month after submission of a separate monthly invoice by Klarna.   • Direct banking: Available in Germany, Austria and the Netherlands. Your account will be debited directly after placement of your order.
  • Direct Debit: Available in Germany, Sweden, Austria and the Netherlands. Your account will be debited after shipment of the goods or tickets/ availability date of the service ​or in case of a subscription in accordance with the timelines communicate​d. You will be notified about the date(s) by email.
  • Card Payments: Available in Germany. The amount will be reserved on your card and will be debited after shipment of the goods or tickets/ availability date of the service. In case of a subscription the amount will be debited in accordance with the timelines communicate​d.

The payment methods Pay in [14] days, Slice It and direct debit are only available in case of a positive credit assessment. For this purpose, during the order process and handling of your purchase, we forward your data for an address and credit check to Klarna.
